TERMS AND CONDITIONS

These Terms and Conditions govern access to and use of the SCHWITT SHOT online store available through schwittshot.com and primelabel.shop, as well as purchases made through these websites.

2. Acceptance of the Terms
By accessing the websites, creating an account or placing an order, you confirm that you have read and accepted these Terms, the Return and Refund Policy and the Privacy Policy.
A customer must be at least 16 years old to place an order. A customer under 18 confirms that the customer has obtained the consent of a parent or legal representative whenever such consent is required by applicable law.
Completion of a payment authentication procedure, including 3-D Secure, confirms the payment operation but does not replace parental or legal representative consent where such consent is legally required.
3. Products
SCHWITT SHOT sells clothing and accessories, including:

T-shirts;

headwear;
-
fashion accessories;
-
limited-edition collections and drops.
Product descriptions, available sizes, materials, colours, care instructions, photographs and availability information are displayed on the relevant product pages.
Due to differences between screens, lighting and production batches, the actual colour of a product may differ slightly from the colour displayed online. This may be particularly noticeable with shades of red.
SCHWITT SHOT uses outsourced production partners. Product manufacturing or assembly locations may vary between production batches.
4. Made-to-order and personalized products
Most SCHWITT SHOT products are produced after an order is placed.
Producing a standard product after an order is placed does not automatically make that product personalized. Standard products remain subject to the statutory return rights described in the Return and Refund Policy.
Customers may request individual tailoring or personalization for an additional charge starting from USD 50, including embroidery of a name or phrase on the left shoulder, such as “Special for Araqelyan.”

Before production begins, the customer must approve the requested personalization, spelling, size, placement and any other individual specifications.
A product manufactured according to the customer’s individual requirements, including personalized embroidery or individual tailoring, cannot normally be cancelled or returned because the customer changed their mind. This restriction does not apply where the product is defective, damaged, materially different from the approved specifications or otherwise non-compliant with applicable law.
5. Prices and currencies
The base currency of the store is the United States dollar.
Prices may also be displayed in Armenian drams through Shopify’s currency-conversion functionality. A converted AMD amount may change based on the exchange rate used by the website or payment system.
The final price, transaction currency, taxes, shipping charge and total amount payable are displayed before the customer confirms payment.
Unless expressly stated otherwise, displayed prices include applicable taxes.
A customer’s card issuer may apply its own currency-conversion rate or fees. Such bank charges are outside the control of SCHWITT SHOT.
6. Payment
Payments are processed through the Ameriabank vPOS payment system.
Available payment methods may include Visa, Mastercard and ArCa. Any additional payment methods are available only when they are expressly displayed at checkout.
Prime Ecosystems LLC does not receive or store the customer’s complete card number, security code or other full card credentials. Card information is entered and processed through the relevant payment provider’s secure payment environment.
An order is considered received after successful payment authorization. The customer receives an email confirmation and an order number.
7. Promotional codes and gift cards
Only one promotional code may be used per order unless the website expressly states otherwise.
Promotional codes:
-
cannot normally be combined;
-
have no cash value;
-
may be subject to expiry dates and product restrictions;
-
cannot be applied retroactively after an order has been placed.
Where a one-time promotional code was used on a product that is validly returned, SCHWITT SHOT may provide a replacement code with substantially equivalent conditions.
Where payment was made using a gift card, the amount paid using that gift card will normally be restored to the same gift card or issued as replacement store credit.
8. Order review and correction
Before payment, customers must check:

colour;
-
personalization details;

delivery address;
-
telephone number;

email address;
-
total price.
After placing an order, the customer can review the information in the confirmation email and, where available, through the customer account.
Address corrections may be requested within two business days after the order is placed. SCHWITT SHOT will make reasonable efforts to apply the correction but cannot guarantee a change if production, fulfilment or shipment has already progressed.
9. Order cancellation
A non-personalized order may be cancelled through the customer account within three hours after it is placed, provided that fulfilment has not progressed beyond the point at which cancellation is reasonably possible.
Personalized or individually tailored orders may be cancelled only before the personalization or individual production process begins.
The customer’s statutory rights after delivery remain governed by the Return and Refund Policy and applicable Armenian law.
10. Seller’s right to cancel an order
SCHWITT SHOT may cancel an order where:
-
a product is unavailable;
-
the website contained an obvious pricing or technical error;
-
payment was not properly authorized;
-
the order is suspected to involve fraud or unlawful activity;
-
the customer supplied insufficient delivery information;
-
production of the requested personalization is technically impossible;
-
fulfilling the order would violate applicable law.
Where SCHWITT SHOT cancels an order for reasons not caused by the customer, all amounts collected for the cancelled items will be returned through the original payment method.
11. Production and delivery
Orders are normally prepared within 3–4 business days.
The store currently delivers throughout the Republic of Armenia using Onex or another delivery provider selected by SCHWITT SHOT.
Estimated delivery times from order confirmation are:

Yerevan: approximately 10–12 business days;
-
other locations in Armenia: approximately 13–17 business days.
These periods are estimates and may be extended during limited drops, unusually high demand, holidays, adverse weather, carrier interruptions or force-majeure events.
Business days are Monday through Friday, excluding official public holidays in Armenia.
A tracking number will be provided where tracking is available.
12. Delivery charges
Standard delivery costs approximately AMD 4,000, displayed in the applicable checkout currency. The exact delivery charge is shown before payment and may vary depending on the order, destination or delivery conditions.
Standard delivery is free for qualifying orders with a merchandise value exceeding USD 179, after applicable discounts and before any amount charged for personalization, unless the checkout states otherwise.
Pickup is not currently available.
13. Delivery address and failed delivery
The customer is responsible for providing complete and accurate delivery information.
If an address clearly does not exist or is incomplete, SCHWITT SHOT may contact the customer for clarification.
Where delivery fails because of an incorrect apartment number, house number, telephone number, customer unavailability or another circumstance attributable to the customer, the customer may be responsible for the reasonable cost of redelivery.
Following an unsuccessful delivery attempt, the parcel may be stored for approximately three business days and a further delivery attempt may be made.
A personalized order may be held for up to ten business days. If the customer does not respond or arrange delivery after reasonable notice, SCHWITT SHOT may take appropriate action regarding the unclaimed product to the extent permitted by applicable law. Mandatory consumer rights are not affected.
14. Loss or damage during delivery
The risk of accidental loss or damage remains with SCHWITT SHOT until the product is physically received by the customer or a person designated by the customer, except where applicable law provides otherwise.
If a shipment is confirmed as lost or materially damaged before delivery, the customer may choose between:

a replacement product, where reasonably available; or
-
a refund through the original payment method.
A gift card may be offered only as an optional alternative and will be issued only with the customer’s agreement.
15. Accounts
Customers may place an order without creating an account.
A customer may maintain more than one account, provided that accounts are not used for fraud, abuse, evasion of restrictions or misuse of promotions.
SCHWITT SHOT may suspend or restrict an account where there is reasonable evidence of:

fraud;
-
unauthorized payment activity;
-
abuse of promotional codes;
-
repeated bad-faith claims;
-
interference with the websites;
-
infringement of intellectual-property rights;
-
violation of these Terms or applicable law.
16. Resale
SCHWITT SHOT products may not be acquired for organized commercial resale without the prior written authorization of Prime Ecosystems LLC.
This restriction does not limit rights that cannot legally be restricted.
17. Intellectual property
The SCHWITT SHOT name, logos, website materials, photographs, graphics and written content are owned by or licensed to Prime Ecosystems LLC.
Original product and apparel designs are owned by Mihran Gevorgyan and are used by Prime Ecosystems LLC with authorization.
No website content or brand material may be copied, reproduced, distributed, commercially exploited or used to create confusingly similar products without the relevant rights holder’s prior written permission.
Customer photographs or content will be used in advertising only after the customer has provided separate permission.
18. Complaints

The complaint should include the customer’s name, order number, description of the issue and relevant supporting materials.
SCHWITT SHOT will first attempt to resolve disputes through direct communication and negotiation. Where no resolution is reached, the parties may use any applicable mediation, consumer-protection or other out-of-court mechanism before applying to a competent court.
19. Liability
Nothing in these Terms excludes or limits rights or remedies that cannot be excluded under Armenian consumer-protection law.
SCHWITT SHOT is not responsible for indirect losses that were not reasonably foreseeable when the order was placed, except where liability cannot legally be excluded.
20. Force majeure
SCHWITT SHOT is not liable for a delay caused by events reasonably outside its control, including natural disasters, war, civil disturbance, border closures, government restrictions, strikes, failures of communications or payment systems, carrier disruptions or major infrastructure failures.
SCHWITT SHOT will take reasonable steps to notify affected customers and resume performance.
21. Governing law and disputes
These Terms are governed by the laws of the Republic of Armenia.
The parties will first attempt to resolve any dispute through good-faith negotiations. If the dispute cannot be resolved, it may be submitted to the competent courts of the Republic of Armenia, without restricting any mandatory jurisdictional rights granted to consumers.
22. Changes to the Terms
SCHWITT SHOT may update these Terms when its operations, services, technology or legal obligations change.
The version applicable to an order is normally the version accepted when that order was placed. Changes will not retroactively reduce mandatory rights relating to an existing order.
23. Language
These Terms are available in English, Russian and Armenian.
The English version is the controlling version to the extent permitted by applicable law. Where mandatory Armenian law provides otherwise, Armenian law takes precedence over any conflicting provision.
